Copyright and DMCA Policy

We respect the rights of creators. If you believe something on aiphoto-generator.com infringes your copyright, tell us and we will act on valid notices promptly.
What this policy covers
AIPhoto-Generator creates new images from text prompts using a third-party AI model provided by Moda. We don't run a public gallery of images made by visitors. A generated image is shown to the person who made it and hosted by Moda at an unlisted link. The example images on our own pages were generated by us, and we publish the prompt used for each one.
This policy applies to:
- material on our website, including our example images and text;
- images generated through the service that you believe copy your work, where you can tell us the link to the image.
We also accept complaints about trademarks and other rights at the same address. Please describe the right and the material clearly.
How to file a copyright notice
Send your notice by email to hello@aiphoto-generator.com with the subject line “Copyright notice”. Under the US Digital Millennium Copyright Act (17 U.S.C. § 512(c)(3)(A)), a notice must include:
- your physical or electronic signature, or that of a person authorized to act for the copyright owner;
- a description of the copyrighted work you believe was infringed, or a representative list if several works are involved;
- the material you believe is infringing and enough information for us to find it, such as the full web address (URL) of the page or image;
- your name, postal address, telephone number and email address;
- a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent or the law;
- a statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on the owner's behalf.
We may share a copy of your notice, including your name, with the person who provided the material, so they can respond. Notices that are missing required information may not be actionable, and we may ask you to complete them.
What happens after we receive a notice
When we receive a valid notice, we will:
- remove or disable access to the material on our website, where we control it;
- ask our image provider to remove or disable the reported image, where it hosts it;
- notify the person who provided the material where we can identify them. Most visitors use the service without an account, so this is not always possible.
How to file a counter-notice
If material you provided was removed and you believe that was a mistake or a misidentification, you can send a counter-notice to hello@aiphoto-generator.com with the subject line “Counter-notice”. Under 17 U.S.C. § 512(g)(3), it must include:
- your physical or electronic signature;
- a description of the material that was removed and where it appeared before it was removed;
- a statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of a mistake or misidentification;
- your name, postal address and telephone number;
- a statement that you consent to the jurisdiction of the US federal district court for the district where your address is located, or, if your address is outside the United States, any judicial district in which we may be found, and that you will accept service of process from the person who filed the original notice or their agent.
After a valid counter-notice, we will send a copy to the person who filed the original notice and tell them that we will restore the material in 10 business days. Unless they tell us within that time that they have filed a court action to stop the infringement, we will restore the material, where we are able to, 10 to 14 business days after we received the counter-notice.
Repeat infringers
We will, in appropriate circumstances, block access to the service and terminate the accounts of people who repeatedly infringe copyright.
False or misleading notices
Under 17 U.S.C. § 512(f), anyone who knowingly makes a material misrepresentation in a notice or counter-notice may be liable for damages. Before you send a notice, consider whether the use could be permitted, for example under fair use. If you are unsure, you may want to ask a lawyer.
AI-generated images and copyright
Every generation is new, and the service does not let you upload or edit existing images. Even so, an AI model can produce an image that resembles an existing work. Our Terms of Service and Acceptable Use Policy forbid using the service to infringe someone else's intellectual property. We don't claim ownership of images people generate, and copyright protection for AI-generated images varies by country and may not be available.
